SPECIAL DAY SUPPLIES -- RENTAL AGREEMENT AND LIABILITY WAIVER

By completing this booking, the renter agrees to the following terms in their entirety:

1. EQUIPMENT RESPONSIBILITY
The Renter accepts full responsibility for all rental equipment from delivery until pickup. The Renter will be held fully liable for any damage, loss, theft, or destruction of equipment. Costs will first be deducted from the damage deposit; any cost beyond the deposit amount shown at checkout is the Renter's responsibility and will be charged to the card on file.

2. TENT ASSEMBLY AND DISASSEMBLY
The tent is delivered unassembled. The Renter accepts full responsibility for assembling and disassembling the tent per manufacturer instructions. Special Day Supplies is not responsible for any injury or damage from improper assembly or use.

3. ASSUMPTION OF RISK
The Renter voluntarily assumes all risks associated with the use of the rental equipment by themselves, family members, guests, and all persons present at the event.

4. RELEASE OF LIABILITY
To the fullest extent permitted by law, the Renter releases Special Day Supplies from any liability for loss, damage, injury, or death arising from use of the rental equipment, including burns from hot equipment, falls, electric shock, structural failure of the tent, and any other injury howsoever caused.

5. SUPERVISION OF MINORS
The Renter accepts sole responsibility for the supervision and safety of all minors at the event. Special Day Supplies bears no responsibility for injury to or death of any minor arising from use of the rental equipment.

6. INDEMNIFICATION
The Renter agrees to indemnify and hold harmless Special Day Supplies from all claims, damages, losses, and legal fees arising from the Renter's use of the rental equipment.

7. LATE PICKUP / NOT READY FOR COLLECTION
Please have all rented items disassembled and packed the way you received them at our agreed upon pickup time. If items are not ready upon arrival, a $100.00 fee will be billed. Each additional hour that we wait will be billed at a rate of $50.00 per hour, charged to the card on file.

8. DOGS ON PREMISES
For the safety of Special Day Supplies delivery and pickup personnel, all dogs must be secured inside behind closed doors during delivery, setup, and pickup. If dogs are present and not safely secured upon our arrival, Special Day Supplies reserves the right to suspend services until all dogs are safely secured inside behind closed doors and it feels safe to return. In such cases, the Renter will be billed a $50.00 inconvenience fee plus an additional $50.00 per hour for every hour we are unable to safely conduct our services. This fee will be charged to the card on file. Service dogs with proper documentation are exempt from this policy. Special Day Supplies personnel reserve the right to leave the premises immediately if they feel threatened by any dog, and the Renter shall remain fully liable for any injury caused by their dog to Special Day Supplies personnel or equipment.

9. POWER REQUIREMENTS
The Renter acknowledges that the popcorn machine, cotton candy machine, movie projector, and inflatable movie screen blower all require a 120V outlet. The Renter further acknowledges that the inflatable movie screen must remain continuously plugged in with the blower running for the entire duration of the movie to remain inflated and functional. Special Day Supplies bears no responsibility for equipment failure due to inadequate power, power loss, or the Renter's disconnection of the blower during use.

10. DAMAGE DEPOSIT
A hold, scaled to the package booked and shown in your order summary before checkout, is placed at booking, released upon return of all equipment in good condition. If repair or replacement costs exceed the deposit amount, the Renter is responsible for the additional amount beyond the deposit.

11. CANCELLATION & RESCHEDULING
Cancellations made 7 or more days before the event date receive a full refund of the rental fee. Cancellations made 3–6 days before the event date receive a 50% refund of the rental fee. Cancellations made less than 48 hours before the event date are non-refundable, as equipment and logistics have already been committed for that date. Rescheduling to another available date is offered at no charge with at least 48 hours notice, subject to availability. The deposit hold is never charged for a cancellation made before delivery — it is simply released.

12. WEATHER POLICY
Equipment delivered with a tent (Outdoor, Premium Indoor, Budget Indoor, and Movie Night — Premiere packages) is sheltered from light rain once set up. For packages without a tent (Movie Night — Backyard and Cinema, the Party Snack Bundle, and Tables & Chairs Only), the projector, speakers, and food machines are electronics and are not weatherproof; any rain forecast for the event date may require rescheduling regardless of severity. The inflatable movie screen additionally cannot be safely set up in sustained winds above approximately 20 km/h (12 mph), consistent with standard safety practice for large inflatables. In the event of rain, high winds, thunderstorms, or other conditions that make safe setup or use of electronic equipment unsafe, Special Day Supplies will contact the Renter in advance to offer rescheduling to another available date at no additional charge. If no mutually agreeable date is available, a full refund will be issued.

13. NO REFUND POLICY UPON DELIVERY
The Renter acknowledges that once Special Day Supplies has arrived at the delivery address and begun unloading equipment, the full rental fee is non-refundable under any circumstances. This includes but is not limited to situations where the Renter claims to have misunderstood the scope of services, the assembly requirements of the tent, or any other aspect of the rental agreement. By completing this booking, the Renter confirms they have read and understood all terms including that tent assembly and disassembly is the sole responsibility of the Renter. No refunds will be issued after delivery has commenced. If the Renter chooses not to accept the equipment upon delivery, the full rental fee remains owing and no equipment will be left on site.

14. MINIMUM AGE REQUIREMENT
The Renter must be at least 18 years of age to book a rental and sign this Rental Agreement and Liability Waiver. By completing this booking, the Renter confirms they are at least 18 years of age.

15. GOVERNING LAW
This agreement is governed by the laws of the Province of Ontario, Canada.
